Terms of Service

1. Agreement

These Terms of Service (the "Terms") are a binding agreement between you and KernelGT BPO ("KernelGT BPO", "we", "us"). They apply to StuckThings (https://stuckthings.com), WorldWideManga (https://worldwidemanga.com) and kernelbpo.com (together, the "Services").

By accessing or using the Services you agree to these Terms and to the policies linked from them: the Privacy Policy, Cookie Policy, Refund & Cancellation Policy, Content & Acceptable Use Policy, Copyright / DMCA Policy, Creator Revenue Share Terms and Advertiser Terms. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your country, you may use the Services only with the permission of a parent or legal guardian. Creators who receive payments must also be able to enter into a binding contract and complete Stripe's identity verification.

If you use the Services on behalf of an organization, you confirm that you have authority to bind it to these Terms.

3. Accounts

You are responsible for the accuracy of your account information, for keeping your credentials secure and for all activity under your account. Tell us promptly at contact@kernelbpo.com if you suspect unauthorized use.

4. Creator content and license

Creators retain ownership of all intellectual property rights in the works they upload ("Creator Content"). KernelGT BPO does not claim ownership of Creator Content.

By uploading Creator Content, you grant KernelGT BPO a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, transmit and monetize your Creator Content on and through the Services (including through subscriptions and advertising), and to create the technical copies and formats needed to operate the Services. This license lasts while your content is available on the Services and for a reasonable period afterwards to remove it from backups and caches. Because the license is non-exclusive, you remain free to publish your work elsewhere.

Readers and subscribers receive only a personal, non-commercial right to view Creator Content through the Services. They may not copy, redistribute or resell it.

5. Creator warranties

By uploading Creator Content, you represent and warrant that:

• you are the author and owner of the content, or you hold all rights, licenses and permissions needed to grant the license above;
• the content does not infringe the copyright, trademark, privacy, publicity or other rights of any person;
• the content complies with our Content & Acceptable Use Policy and with applicable law; and
• all information you provide, including payment and tax information, is accurate.

6. Subscriptions, payments and fees

StuckThings subscriptions are billed through Stripe. Refunds and cancellations are governed by the Refund & Cancellation Policy. Creator earnings are governed by the Creator Revenue Share Terms. Advertising on WorldWideManga is governed by the Advertiser Terms.

7. Prohibited conduct

You agree not to violate the Content & Acceptable Use Policy, to interfere with or disrupt the Services, to attempt unauthorized access, to scrape or automate access in a way that burdens the Services, to generate artificial views, subscriptions or clicks, or to use the Services for any unlawful purpose.

8. Copyright complaints

We respond to notices of alleged copyright infringement under the Copyright / DMCA Policy and may remove content and terminate repeat infringers.

9. Indemnification

You agree to defend, indemnify and hold harmless KernelGT BPO, its owner, officers, contractors and affiliates from any claims, damages, liabilities, losses and expenses (including reasonable legal fees) arising from your Creator Content, your breach of these Terms or of the warranties in Section 5, or your violation of any law or third-party right.

10. Termination

You may stop using the Services and close your account at any time. We may suspend or terminate accounts, and remove content, if you breach these Terms or our policies, if required by law, if we receive a valid copyright notice, or if your use creates risk or harm for us or others. Where practicable we will notify you and explain the reason.

On termination, the license in Section 4 ends for new uses, and earned and payable creator balances are handled under the Creator Revenue Share Terms. Sections that by their nature should survive termination will survive, including Sections 4 (as to retention for backups), 5, 9, 11, 12 and 13.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free, nor any level of views, subscribers or earnings. Creator Content is the responsibility of the creators who publish it.

12. Limitation of liability

To the maximum extent permitted by law, KernelGT BPO will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules. Courts located in the State of Wyoming have exclusive jurisdiction over disputes, except that either party may seek injunctive relief in any competent court. Nothing here limits mandatory consumer rights you may have under the law of your country of residence.

14. Changes

We may update these Terms. We will post the new version with its date and, for material changes, give reasonable notice. Continued use of the Services after the effective date means you accept the changes.
